It is important to note that the BOP has held Eric incommunicado since his last legal call. His 20-minutes-a-week legal call to prepare for his case was taken away with no explanation. The BOP is unresponsive, as well as the prosecutor who STILL has not responded to this brutal attack.

The North Central Regional Office needs to open an investigation into the unnamed officer who assaulted Eric in the showers at FCI Englewood on June 18th 2020 and turn said information over to the Inspector General.

The North Central Regional Office also needs to review and open an investigation into the “after action report” when Eric was attacked at FCI Florence in August 2018. They need to review the video footage that showed Eric, a compliant prisoner, being 4-pointed (cuffed to a cot at his wrists and ankles) for several hours before being transferred to ambulatory restraints. It was the Regional Office’s duty to review this footage for abuse. The Regional Office failed to protect Eric while he was under their authority once already. Lets not let this happen again.

This week, Eric was denied his weekly allotted 20 minute legal phone call given to him to prepare for the case. FCI Englewood is holding him incommunicado since the recent attack on Eric in the showers. The Regional Office needs to make sure that the prison sets up a legal call THIS WEEK. We do not know his current health status and are gravely concerned.

Some questions the Regional Office need to answer

Is there any open investigation into this same officer throwing a book at Eric in 2019? (The same officer that attacked Eric recently in the shower)

Is it prison policy to continue contact between an officer and prisoner after a “use of force complaint” is filed by a prisoner?

Is it policy that a “use of force” investigation be carried out after a prisoner alleges an attempted assault? (Eric has an ongoing grievance regarding the officer who assaulted him in 2019 throwing a book at him)

Is it policy to allow an officer that a prisoner alleged attempted to assault them, take that prisoner anywhere alone, off camera? (This officer has TWO documented incidents with Eric in the shower that occurred after Eric’s complaint of assault was made)

Why would an officer who wrote a specific prisoner up for assault be continued to be assigned to that specific prisoner’s unit? Is it policy to continue to house a prisoner at the same prison after such allegations are made?

Is there an open investigation into how FCI Englewood handled Eric’s PREA complaint that was filed in 2019? There needs to be.

The Marshals need to know FCI Englewood is holding Eric incommunicado from his lawyers after this most recent attack on him in the showers.

The Colorado Marshals have been made aware over and over that Eric King is not safe at FCI Englewood yet they refuse to transfer him elsewhere. Because of this deliberate indifference Eric was attacked by guards while cuffed up in the shower on June 18th 2020. It is time that the Marshals who are bound to protect pre-trial prisoners move Eric to another facility and open an investigation to both Eric’s recent assault and the attempted assault in 2019 by the same unnamed officer.

There are 6 other facilities that are non-BOP that Eric could be easily placed at during pretrial.

The Marshals are the ONLY entity that can authorize a move pre-trial (at least without court intervention). With SO many warnings regarding Eric’s safety, why are the Colorado Marshals digging their heels in and refusing to move him?

Documented communication over the past year that show the Marshals have been made aware of the danger of continuing to hold Eric at FCI Englewood

On August 21st 2019 the Marshals were made aware Eric needed medical attention for a potential mini stroke he had earlier that month. Eric has yet to receive ANY medical care or medical evaluation by experts.

The Marshals have been notified over and over that FCI Englewood is interfering with Eric’s ability to be able to have adequate pre-trial communication with his attorney to prepare his defense.

On Sept 6th 2019 the Marshals were made aware that their decision to place Eric at FCI Englewood was going to be a danger to him.

On September 27th 2019 the Marshals were made aware of a threat that an officer made to have Eric raped as well as other disgusting things said by the guard.

On April of 2020 the Marshals were made aware of Eric being placed on suicide watch but continued their deliberate indifference and chose to merely keep Eric at FCI Englewood.

How would it make folks feel to know that Eric had an active grievance filed about the officer that slammed Eric’s head into the concrete while his hands were cuffed behind his back in the shower?

Or that FCI Englewood currently does not have an officer assigned to the specific facility that investigates officers who violate prisoners?

Or that this officer has given Eric SIX bullshit disciplinary write-ups in the last 6 months?

How about that when a prisoner complains about an assault or attempted assault, by policy it needs to be investigated and the officer needs to be removed from contact?

And if they have ZERO concern for Eric’s safety, then we defer to the policy in which: if a staff member claims they were assaulted by a prisoner and a protection order goes into place, the prisoner is not put in a situation where they interact with that specific guard from that point forward. 


This shot was given the DAY after the prosecutor was given evidence (per this prisoner) that staff at FCI Englewood were attempting to coerce another prisoner into attacking Eric.

Putting aside the fact that this shot against Eric for assault” was given THE DAY AFTER THE DOCUMENT PROVING AN ATTEMPTED ASSAULT ON ERIC WAS DELIVERED TO THE PROSECUTOR…..

If this guard really felt that Eric assaulted him in the shower by allegedly flicking water at him, then why was he so determined to (against policy) continue to interact with Eric?

The fact is when this officer threw a book at Eric, that should have stopped this officer from interacting with him. But he has since been able to give Eric disciplinary write-up after disciplinary write-up. Plenty of time to come and threaten Eric. To tell him that we (“your folks on the outside”) should tell the world about what a strong union they have and how prison guards can do whatever they want.

We are going to honor his request: we are going to tell the world the prison, the union and North Central Regional Office actively shelters abusers.


A Tale of two Shots

These are two very different disciplinary write-ups delivered to Eric for the same incident. Delivered 11 days apart….

Only ONE of these two things can be true. Did the Counter Terrorism Unit flag these union cards, or was it SIS officer *******?

Why would the Counter Terrorism Unit of the BOP be so concerned with union cards?

Why would FCI Englewood re-write this disciplinary shot after it was confirmed to Eric there is no Counter Terrorism Unit (CTU)?

So IS there a CTU?

Is Englewood actively fabricating disciplinary write-ups as a method of intimidation?

So many questions….

Eric assaulted by guard at FCI Englewood

On June 18th Eric was taken into the showers while shackled, and was then attacked. The guard took the metal detection wand and swung at each of Eric’s ankles, and when Eric would lift his leg this officer would swing at the other. The guard then picked Eric up and dropped him on his head onto the concrete in the shower. He woke up after losing consciousness for 10 seconds thinking they were pouring water on his face. But it was his own blood. 

Eric was transported to Swedish Medical Center, was given 6 stitches and was diagnosed with a moderate to severe concussion. The hospital would not give Eric the results of the scan, or release it to his family or lawyer, because they told him “he is government property”. 

The reality is, folks have been fighting for over a month to get an expert in to assess Eric. We believe he is suffering from a traumatic brain injury after officers at FCI Florence kicked him in the head for 5 minutes in August of 2018. We were so hopeful that we were going to be able to get help for him and see where he is at with the mixture of trauma and brain injury he has been struggling with. His memory has been affected, as well as many other aspects of his life. Officers at FCI Englewood know this. They knew that we were trying to get a medical expert because of a head injury… and then they dropped him on a concrete fucking floor on his head in the bathroom while shackled up.

This all follows evidence that his case manager out of FCI Englewood attempted to make a deal with a WP prisoner (who did not cooperate) to get Eric attacked. This information was turned over to the courts before they denied Eric’s transfer to another facility. What the prosecutor chose to do with this evidence, evidence that a crime was committed at FCI Englewood, was merely to run and tell Englewood prison about the evidence. Within a week, both Eric and the WP prisoner had assault shots from water “assaulting” guards at two different sections of the prison.

The guard who recently attacked Eric was the same guard who claimed Eric assaulted him with a drop of water. The prison attempted to refer this case to the FBI for prosecution but less than a month ago, the FBI released the case back to the prison, meaning the guards’ attempt to have Eric charged criminally from those shots fell flat.

But the reality at this point is Eric is not safe in BOP custody. Over the past two years, at 5 different prisons, the BOP has a pattern of placing white supremacists in cells, or in fenced in areas, close to Eric on his tier, in an attempt to have Eric attacked. 

When Eric returned from the hospital, he discovered his entire tier was attacked and pepper sprayed after Eric was left. He was denied the ability to contact his attorney and family. It was only on Eric’s weekly allotted 20 minute legal call that we were given this news. The prison also denied him last week the ability to consult with his counsel when he had an appellate deadline. The pattern of BOP intervention impeding his ability to fight his case continues. 

  • The US Marshalls need to move Eric to a non-BOP facility during leading up to trial
  • The North Central Regional Office NEEDS to open an investigation into this officer, as well as the ones that may have been standing by watching. When Eric asked for an investigation to be opened, he was denied.
  • The prosecutor needs to drop this fucking case.

We are very hesitant to ask for folks to call in and advocate for Eric because the last time this happened, a year and a half ago, his phone privileges were taken away. But at this point Eric needs all our help.

The Warden at FCI Englewood has decided, during a global pandemic to remove all general mail from Eric. This illustrates so well the deliberate indifference that belongs to ALL wardens to the lives of prisoners. While further isolating Eric that you have on a suicide management plan. 

For the next 6 months (until this restriction is re-evaluated) Eric will be unable to send or receive any mail from anyone other than his mother and wife. 

This is completely devastating for those who care for Eric, worrying about the difficulties of him surviving torture while so isolated. But there is a bit of good news in this. Eric will still be able to receive books and magazines. 

Right now this is the only way to let Eric know folks out here are rallying for him and here to support him during this terrifying and turbulent time for him.

“Encouranging Others to Riot” by poem… the haps at FCI Englewood

While the BOP is upgrading their website and pretending they have some sort of plan to keep folks alive during this pandemic, FCI Englewood is again up to no good.

We can assume in a retaliatory (previously predicted) move inspired by either a) the court filings regarding the ongoing and constant abuse the BOP is continuing to serve Eric via FCI Englewood or b) the article that was published that exposes some pretty gross fash BOP/Guard, Eric has been given two separate severe disciplinary infractions.

All disciplinary write-ups are categorize by severity level, 300’s being least severe and 100’s being the most severe. Different level offenses bring on different disciplinary procedures. But the common theme in all of them is the only defense you are allowed (because no lawyers) is: one of *them* (BOP) that they pick to “defend” you… against their own. 300’s don’t even involve hearings and 200-100 series shots can come with additional federal criminal charges.

Eric was given two shots, one of the greatest severity offense (100 series) and highest level of offense (200 series).

The 100 series shot Eric received on 3/31 was for
1. Encouraging others to riot and
2. Use of the mail to further criminal activity (greatest seventy)

The story goes the CTU or Counter Terrorism Unit of the BOP contacted FCI Englewood when a NY ABC newsletter that is sent into prisons re-published a poem that Eric wrote that the BOP is considering a direct threat to the warden.

100 series shots, or GREATEST level severity shots carry some pretty hefty sanctions

When speaking with his staff representative Eric was told that the only way to even SEE this “evidence” against him is to file a Freedom of Information request since it is classified. They recommend he just plea to the disciplinary charge

Already disciplinary hearings are a joke and now he is not allowed to even review the evidence against him. Despite the fact this could impact his legal case he is not permitted his own defense or even to MEET with his lawyer at this time. This shot as well as the other can carry the shadow of a potential charge whenever it strikes their fancy. The Federal Colorado prosecutors waited until a year after his first incident to bring up the charges Eric faces now in court.

Eric’s second shot came on 4/3 when he was showering and a guard led a sex offender into and through the showers. The guard alleges that Eric shook a shampoo bottle at them and a drop of water got into the guard’s eye.

Eric is now being charged internally again for assault of an officer.

It really is unnecessary to unpack this with some deep explanation for what is going on here. Its pretty blatant. Eric was clear Englewood was going to find a way to prevent his family from visiting…. that happened. And it will likely follow Eric for the rest of his sentence. No, there will be no justice in these hearings as there has not been justice for anyone who has sat in those hearings before Eric. There is no justice for the now 13 dead federal prisoners because of BOP failures. Why would we find justice in *their* disciplinary system.

Prose and musings are threats worthy of years of restricted contact with families apparently. Business as usual at FCI Englewood on this Tuesday afternoon.

Eric can still use letters and books. His capacity to respond is severely limited because he isnt allowed to hold onto his letters but he is making an effort and appreciates the support.

Word from Eric amid the COVID-19 outbreak

We have word from Eric. FCI Englewood has cancelled visits for 30 days. However, staff has yet to wear masks into the facility. With the BOP on a hiring freeze, it is going to get really interesting if prisoners start to get sick. The BOP has issued a statement saying that attorney visits are also suspended for 30 days. The BOP is so quick to cut outside visits because prisoners are such a vulnerable population, yet they will not spend the $.50 per guard per day to prevent staff from infecting prisoners. Eric says that they took “the good soap” leaving them with this horrible grainy prison-brand soap. Prisoners are also being denied access to the law library at FCI Englewood.

The BOP has issued a statement saying that prisoners are now allowed to purchase 500 phone minutes in comparison to the previous 300 minutes before to help keep families in contact. However, the reality is many in the segregated housing units (SHU) across the BOP do not have access to the phones (and if they do, they get just one 15 minute call a month). They do not have access to email, letters are held and delayed by the prison and now they are not even permitted legal or regular visits (SHU visits are behind glass or video). FCI Englewood is choosing to uphold the illegal phone block they brought against Eric. Suddenly he finds himself being held pretty incommunicado again.

This is a reality Eric shares with so many across the nation. Forced to wait helpless while the prison fails to act to keep them safe. During this pandemic, prison staff who interact with prisoners should be wearing masks to help limit the transmission of the virus. During incubation people are contagious so at the very least, masks should be a requirement for ALL staff interacting with prisoners. Further, the BOP needs to give out soap and cleaning supplies and subsidize the cost of vitamins and medicine to treat illnesses. SHU prisoners who do not have access to email or phones need to be allowed access to email and phone at least once per day while visitation is suspended. The BOP needs to end ALL commissary restrictions for SHU prisoners. They need to also stop limiting the number of stamps SHU prisoners are allowed. Prisoners need to also be allowed unmonitored phone calls to their attorneys while they are being held incommunicado.

The BOP needs to put their plan in writing to keep the over 146,000 people in BOP custody (and the additional 28,000 in other facilities) safe (similar to what every other government agency is currently doing). Simply holding the entire prison population from their loved ones is not handling an outbreak.

Among that population, the BOP currently has 10,642 prisoners in segregation. This leaves 9,441 prisoners facing the same situation Eric is this morning: in the SHU of a regular BOP prison suddenly finding themselves in complete isolation without even legal visits. On top of that, they have no email access and only one phone call a month if they are lucky. They are often restricted in what they can buy on commissary (including medicine, soap and food). Out of those 10,000 people, only 1,597 are in disciplinary segregation which means the rest of the population (9,441)  is not even serving disciplinary sanctions.

From the BOP’s indexed files there are currently two prisons with potentially exposed staff and they are not asking the EXPOSED guard’s wife who also works at the prison to quarantine. The BOP is not even taking the simple precaution of wearing masks

Setting up an account requires a credit card and you will be charged for viewing any document over $15 a quarter. So they are public record but …as much as requiring someone to setup a *paid* account can be considered “public record”. Because the way this system works excludes those from accessing this information without disposable funds or bank accounts, and in an attempt for total transparency, his legal team will be posting these court documents on the fundraiser page for all to see.

The first filings have been posted on the fundraiser page under campaign updates. Filed today was a motion to continue and various supporting documents.
